In any event, it was reasonable to conclude that there was an election machinery failure. It was widely known that machine counts were not always accurate, especially with punch card ballots. Even the expert hired by the Bush team for the later election contest to dispute the Democratic claims of the machines’ inaccuracy had applied for a patent on a new type of machine, pointing to the accuracy problems with the existing punch card voting and vote tabulation systems.
